A recent study by the Center for Retirement Research at Boston College identified excessive fees, inappropriate investment options, and self-dealing as the primary reasons for lawsuits against 401(k) plans. In this session, we will look at those underlying causes for litigation, how class actions are changing the behavior of plans, and how these cases are often decided based on whether a prudent decision-making process was employed. Finally, we will explore the difference between regulatory compliance versus adhering to professional standards of conduct.
